Under the Law No. 6698 on the Protection of Personal Data (“KVKK”) Regarding the Protection of Personal Data

Pursuant to the Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal data will be processed by our Companies (“AKYAPAK ULUSLARARASI DIŞ TİC. MAK. SAN. A.Ş.” and “AKYAPAK MAKİNA SANAYİ VE TİCARET A.Ş.”) as Data Controllers, to be used, recorded, stored, updated, transferred, and/or categorized for business purposes within the framework explained below.

In this context, our Companies take all necessary technical and administrative measures to ensure an appropriate level of security in order to prevent the unlawful processing of your personal data, prevent unlawful access, and ensure its safekeeping, in accordance with the Laws and Regulations established to protect personal data, particularly to safeguard privacy and protect the fundamental rights and freedoms of individuals.

The target audience of this text includes all natural persons whose personal data is processed by our Companies, excluding our employees or job applicants who have applied to our Companies.

The personal data processed as a data controller are listed below, including but not limited to those specified here:

Name, surname, Turkish ID number, address, phone number, email address, signature, physical location/security camera recordings, call center/service quality audio recordings, bank account number, and cookie records.

Purposes and legal grounds for the processing of personal data:

  • To benefit you and/or the institution or organization you represent from the products and services offered by our Companies, to carry out necessary activities for determining and implementing the commercial and business strategies of our Companies, conducting marketing activities, and performing business development and planning activities, including but not limited to these,
  • To carry out administrative operations related to communications conducted by our Companies,
  • To ensure the physical security and monitoring of the locations used by our Companies,
  • To establish relationships with business partners/customers/suppliers (authorized persons or employees),
  • To fulfill contractual requirements and ensure financial reconciliation for products and services provided jointly with our business partners, suppliers, or other third parties,
  • To implement the human resources policies of our Companies,
  • To process data for the use of our Companies' call center or website,
  • To process data for participation in training, seminars, or events organized by our Companies.
  • Method of collecting, storing, and transferring personal data; The personal data you share with our companies can be collected verbally, in writing, or electronically through automatic or non-automatic means via offices, branches, call centers, websites, social media platforms, mobile applications, and similar channels. Your personal data will be stored in electronic and/or physical environments. To ensure that your personal data obtained and stored by our companies are not exposed to unauthorized access, manipulation, loss, or damage in the environments where they are stored, necessary process designs and technical security infrastructure developments are implemented.

    Your personal data will be processed with all necessary information security measures taken, and will be used only for the purposes and within the scope communicated to you. It will be stored and processed for the legal retention period, or if no such period is specified, for as long as necessary for the purpose of processing. Once this period ends, your personal data will be removed from our Companies' data flows through deletion, destruction, or anonymization methods.

    Your personal data will be processed in accordance with the Laws and other applicable regulations, and for the stated purposes as follows:

  • To companies operating on behalf of our Companies and with our authorization, and to our representatives,
  • To regulatory and supervisory institutions, and public institutions or organizations authorized to request your personal data under the applicable laws,
  • To business partners, suppliers, contractor companies, banks, credit risk and financial institutions, and other natural or legal persons within the scope of the stated purposes,
  • To tax and similar consultants, persons and institutions related to legal follow-up processes, and third-party consultants including auditors, and, without limitation, to domestic and international business partners, third-party service providers, authorized persons, and organizations for the above-mentioned purposes.
  • Your rights under Article 11 of the KVKK:

    Pursuant to Article 13, paragraph 1 of the KVKK, you can submit your request regarding the exercise of the above-mentioned rights to our Companies in writing or through other methods determined by the Personal Data Protection Board. As data subjects, if you submit your requests regarding your rights to our Companies, depending on the nature of the request, your request will be concluded as soon as possible and, at the latest, within thirty days free of charge. However, if the process incurs an additional cost, the Company will charge a fee in accordance with the rate set by the Personal Data Protection Board.

    In this context, data subjects have the following rights:

  • To learn whether personal data is being processed,
  • If personal data has been processed, to request information,
  • To learn the purpose of processing personal data and whether it is being used in accordance with its purpose,
  • To know the third parties to whom the personal data has been transferred, both domestically and internationally,
  • To request the correction of personal data if it is incomplete or incorrect,
  • To request the deletion or destruction of personal data in accordance with the conditions specified in Article 7 of the KVKK,
  • To request that the transactions performed in accordance with items (e) and (f) above be notified to the third parties to whom the data has been transferred,
  • To object to the result of the analysis being made solely by automatic systems that leads to a negative outcome for you,
  • To request compensation for damages in case you suffer damage due to unlawful processing of your data.
  • To exercise the rights mentioned above, you can personally deliver your request letter along with the necessary information to verify your identity, or send it through notary to the following address: "AKÇALAR MAH. KORUÇEŞME CAD. 8/A AKÇALAR/NİLÜFER/BURSA."

    1. GENERAL

    In order to evaluate and resolve applications promptly, effectively, and comprehensively in accordance with Articles 11 and 13 of the Personal Data Protection Law No. 6698 ("KVKK") by you, the data subjects, this Application Form has been prepared by AKYAPAK ULUSL.DIŞ TİC.MAK.SAN.A.Ş. or AKYAPAK MAKİNA A.Ş. ("AKYAPAK" or "Company") in its capacity as the data controller.

    2. APPLICATION

    Pursuant to Articles 11 and 13 of the KVKK, you, the data subjects, may submit your requests regarding the implementation of the KVKK to our Company, which has the status of data controller, in writing by filling out this form or through other methods determined by the Board:

  • By personally submitting a wet-signed copy of this data subject application form to Akçalar Sanayi Bölgesi, Koru Çeşme cad.No:8/A 16225 Akçalar / BURSA,
  • By sending a wet-signed copy of this data subject application form via registered mail to Akçalar Sanayi Bölgesi, Koru Çeşme cad.No:8/A 16225 Akçalar / BURSA,
  • By sending a wet-signed copy of this data subject application form electronically signed to akyapakvk@akyapak.com.tr or akyapakvk@akyapak.com email addresses.
  • You, the data subjects, can benefit from this right by making your applications in Turkish.

    3. INFORMATION ABOUT THE DATA

    In order for us to recognize you and for AKYAPAK to conduct the necessary investigations, evaluations, and resolutions regarding your application pursuant to the relevant article of the KVKK, we kindly request you to download and fill out the following form completely.

    4. APPLICATION PROCESS

    In applications made by third parties on behalf of the data subject, a notarized power of attorney must be sent to us together with this form, and in applications made on behalf of children under guardianship/custody, a copy of the documents proving the guardianship/custody relationship must be sent to us together with this form.

    To ensure the security of your personal data, within seven (7) days of the date your information request reaches AKYAPAK, AKYAPAK may contact you to confirm that you are the data subject and may request some information and documents from you. The information and documents you provide to us in this context will be destroyed immediately after confirming that you are the data subject.

    If the requested information and documents are incomplete, the requested information and documents must be completed and sent to us upon our request. Until the information and documents are fully provided to us, the thirty (30) day period mentioned in Article 13/2 of the KVKK regarding the conclusion of the request will be suspended.

    5. CONCLUSION OF THE DATA SUBJECT'S REQUEST

    Depending on its nature, your request will be answered as soon as possible and within a maximum of thirty (30) days from the date it reaches us in accordance with the KVKK. Our responses and evaluations will be communicated to you in writing or electronically in accordance with Article 13 of the KVKK, based on your choice in this application form. If you have a preference for receiving the application result via mail, email, or fax, please select the preferences in segment B of the form.

    Your requests will be concluded free of charge by AKYAPAK. However, if the response process incurs an additional cost, a fee may be charged in amounts determined within the framework of the relevant legislation.
